The federal law defines hemp as cannabis with less than 0.3% delta-9 THC on a dry-weight basis under the 2018 Farm Bill. The DEA has stated that THCA does not meet the hemp definition because when heated it becomes delta-9 THC. That means even if a state legalizes THCA flower the federal risk remains. I checked several state pages and the wkf legality map to see how laws differ. Until Congress clarifies the hemp definition the market carries a built-in uncertainty. Most people don’t realize how fragile this setup is until something changes at the federal level and it ripples through every state overnight.
